Child custody/Mom using drugs Alvin

TEXAS... The mom of my daughter and I have equal custody. I have her one week and her mom the other.
I pay no child support (moms idea) I volunteered to pay child care so my daughter would not be exposed to different people every day watching her. Mom has any one or every one watching my daughter. I felt like my daughter needed some sort of stability. Here are the Problems. Mom using drugs, drinks almost every night
(underage) have active arrest warrant and is going to be evicted from her apt for none pay.I have a video of her smoking pot, day care documentation stating my daughter smelled like pot, documentation staing she has arrest warrant, and witness to drug use with my child in next room. Could I take this to court and get full custody and prove mom unfit?

It does sound like enough evidence to start trying for sole custody.Document everything. That is crucial to your case. As far as her warrant if you had no problems to keep you from getting at least physical custody you would get the child.Then get legal council.BEST REGARDS.

If she has a warrant out for her arrest, can't you just call the police and tell them where to find her?

Video is probably inadmissible.
Day care documentation is admissible, but you will need to prove the child was with the mother immediately prior.
Another strategy: If she gets evicted and has no place to live, you could request temporary custody pending a hearing on final custody.
Danger: if she gets evicted and goes to court to sue you for child support, she will probably get it.
I suggest you get to court first.

me and my dad suspect mom is using drugs.
he said the only wayfor a father to get custody of their child is to get a private detective which costs a lot but its worth it. all u need is a few picutes or videos.
i am old enough to choose where i want to live but i have a 3 year old half brother and we told his father what is going on and this is what he is going to do here soon. please take advice and call an attorney first and ask for advice there too.
