I live in Wisconsin. My temporary order was signed by the court on October 3, 2008, ( I still have not received any child support payments yet) ordering my husband to pay 983.00 in child support a month, going back to September 1. At the time, I had just started working and still have little income of my own since I have been out of the workforce since 1989. My husband deposited money in our joint account in September and October so I could make the mortgage payment, pay bills, etc. Now he wants me to sign a paper so that he will not have to pay the back support for September and October. Any advice????????????

He should not be giving any money directly to you.
All money should go through the Child Support Enforcement Agency. If possible, send the money back to him and have him deposit it with the CSEA. They will forward it on to you, and he will get credit for the payment. |

I would say if he deposited enough in your account to cover those two months, sign it.

I have my doubts that the paper would mean anything to CSEA, signed or not.

Probably...but at least it would show an attempt of good faith towards the payors position.

If the mother wants to do what is fair, perhaps the easiest way would be for her to pay the money back to the father as she receives support.

Agreed - though I'd TRY to get the arrears dimissed through the agency first. Even if she just returns the arrearage amount (from her weekly payments) so she can continue to make ends meet. It'd take forever with that plan though...
