Default MOTION FOR PROCUREMENT OF EXPERT TESTIMONY FEE

The motion below was filed in a MO County Court by an Adlitem.

On: 01/08/2007 Docket Entry: Notice
Text: NOTICE FOR 1/12/07 @ 8:30 AM, MOTION FOR PROCUREMENT OF EXPERT TESTIMONY FEE DEPOSIT AND MOTION TO SHORTEN TIME AND ENTER EMERGENCY ORDER FILED.

This adlitem is trying to get a court order so his bias expert witness can be paid a fee of $3000 to $6000.
She has not been deposed yet and the hearing dates are next Fri, Jan 19th, 22nd and 23rd.

The MO court of appeals reversed and remanded everything this lower court had previously ordered when they took my child from me and gave custody of him to his father, whom I was never married too and who never pay any of the $35,000,00 in back child support that he was ordered by this same court to pay in 2000.
They have postponed this remand at least 10 times since it was ordered reversed and remaned in Aug 2004.

My Question is, can this court submit an order that says I have to pay this fee of $3000 to $6,000 within the next 7 days?
And if I can not afford to pay this, can they use non-payment as a reason to not give custody of my son back to me?
Less than 4 months ago this court ordered and I payed this same person $3,950.00 to be interviewed by her on 4 dates for aprox 7 hours total.
I also pay her over $6,000, after it was court ordered back in 2002 when they took my son. Thank you for your time and help!

Finances alone cannot justify that; you should take your income statements and budgets and bank records etc. if need be to the judge to show inability to pay at this time.
