Found father after 16 years!
I just located father after 16 years and have filed with Ohio CSEA and will be having DNA testing. I filed with them once before and could not locate. How far back can I get this father to pay? Is there a statue of limitations in Ohio? Will there be a hearing? He is out of state and wish not to see.

Not sure...but I think you have to go to court for back child support. The child support agency can't award back child support to my understanding.

Should I get an attorney for this or leave up to CSEA of Ohio? I want to go back for the full 16 years.

To go for the whole 16yrs you should get an attorney. At your child support hearing, they will determine what amount will be awarded from this point on (I was told by my local agency that they do NOT deal with back support). The magistrate or judge will sign it and submit it. If neither party objects, it is ordered. You can object for back support. This opens the door for custody/visitation hearings.
Many men who don't want to be a part of thier childrens lives will suddenly play "victim" if ordered to pay child support. He may all of the sudden feel he HAS to make up for lost time and be a part of your childs life to get back at you. Be careful what you "ask" for. Or...he may just disappear. Get an attorney, at least consult with one BEFORE the hearing. You will likely have to retain one for your back support. |
