My wife and I are traveling to the Philippines and found out that a relative has just had a baby and is unable to take care of it and wants my wife and I to adopt which we would love to do. What is the process?

Are you US citizens?
Contact your state officials and immigrationcounsel re the adoption procedure, You often still have to go through the steps of home studies etc. in most situations to get the visas required etc. But I would suggest you do have counsel assist. |

Filipino law allows for the adoption of a relative as long as that child is within 4 degrees of consanguity. This means that the child must be the prospective adoptive parents grandchild, great grandchild, great-great grandchild, brother, sister, niece, nephew, grandniece, grandnephew, aunt, uncle, or first cousin. A child who is any other relation (i.e. a first cousins child) would not be eligible to be adopted through a relative adoption in the Philippines.
There is another class of adoption, called identified adoptions. This is when a family knows of a child in the Philippines that they want to adopt but that child is NOT related to them. These types of adoptions are much, much more difficult to get approved and I have serious doubts that they will be eligible for approval under the Hague. If both parties are in totall agreement in most states there is a agreed custody change packet you can fill out you both sign it and one 10-15 minute hearing in front of a judge and its done.
