Default birth mom question

I had a child when i was 17 and placed him for adoption. we reconnected when he was 20 and his adoptive parents have given up on him and have no contact with him. He met a girl that he went to high school with and she had a child. They got married and had a daughter. He is in jail and will be there for quite some time. His soon-to-be x wife has told me that i have no rights to see the grandchild since i, "didnt care enough to keep my son and gave him away".
I have always called both children my grandchildren and have always treated them the same and now i cant see either of them. Do i have any rights sine he is over 18?

That's tough.

Figure anything out on this? Some states allow adult "adoption". Maybe you could adopt your son back then be an "official" grandmother. This may not mean much though unless your state has "grandparent" visitation laws.

I don't think that would make any difference in their rights to see their grandchild. Most States do not have Grandparent's rights. It is up to the parents to determine who their child associates with, and if one parent is in jail then they effectively have no say.

How long have you been around the children?I know in ohio they have grandparents rights..Even if you arent blood, or whatever the situation is. The courts will ask you if you have a grandparent relationship with the child, and if so you can file.
