colville tribal Custody Case Involving abuse and alienation

I need to know if colville tribal cps can take your child for a year old drug charge that spokane cps already took her for once. I got custody back because she was being abused then tribal cfs took her 2 weeks later and gave her back to her father without giving me the opportunity for a minor in need of care hearing. On the grounds that I would most likely lose a hearing. However the father that ignored the abuse got her back just like that. Also need to know how to get a forensic to question her and if it was legal for the prosecutor and a cps worker to question her. Is the ICWA adopted by the collville tribe?
