Confused legal procedure for serving

My ex has moved out of state w/our child (we have joint legal custody) and has not volunteered their new address. She has yet to receive her copy of the 'order to show cause' that I filed - #1, because she refused to take it from the "3rd" party when it was presented to her, and now #2, because I don't have an address to send it to her.

Is it legal for me to send her the paperwork via certified mail or Fed-Ex? Would this be considered '3rd party' involvement? Thus, if she doesn't accept it either of these ways, then I have extra back-up to prove that she didn't accept her copy.

Please advise. Thank You for your time.

Default Re: legal procedure for serving

You can try, and explain to the judge she is avoiding service etc.; the judge may deem her served and let you proceed.
