Confused Kind of weird issue.

Okay, Im not really sure if this falls under custody issues, or adoptions. If I am in the wrong place tell me and I will post there instead.

I have a friend whose father recently died. His mother is in jail, and he is staying with a friend's mother. Now, his real mom is getting released from jail in about two weeks. He really doesn't want to live with her, because he is afraid that she will use him just for the social security he will be getting, and to live in the house and not pay the bills, so it will fall back on his older brother who is basically "the man" because he is in charge of his father's estate. My friend wants to stay with his friend's mom, but his real mom wants to take him. I was just wondering if there is a legal way he can stay with his friend's mom. Also, I would like to know if his mother is going to be receiving the Social Security that is supposed to be going to my friend, and if there is a way to keep her from receiving it so that he can get it. Any help would be immensely appreciated.

He could file for emancipation maybe....I'm not too familiar with it, but you could look it up.
