me and the mother of my 5 yr old daughter share joint legal and joint physical, however she lives with her mother. I want to remove her from the house and obtain sole custody due to the fact of a very bad upbringing, drugs and drinkin in house. Am i allowed to take her and not return her.

No. Were you to do that, you would be in contempt of court.
You need to collect solid evidence of the unhealthy environment at the mother's house, such as arrest records for her or other persons at the house. Then you need to present these to the court in an affidavit, along with a motion for temporary custody and a request for a hearing on permanent custody. |
