My ex-wife has sent me a change of support collection to now be collected from the county. She has indicated that I have not paid her support since 2004. She has a sworn affidavit which states I have not made payments and has presented no documents to support this. In our divorce agreement my support is for $200.00 a month. We had made an agreement that I would pay her $100.00 a month because of additional medical expenses and have all documents showing proof of these payments up until my son reached age 19 when I got him a full time job grossing $520.00 a week. He went back to college as a part time student at night and works part time during the day. I pay for his medical insurance, any co-payments and all medical expenses not paid by my insurance and continue to do so. My son lives out of state and for 13 years drove to NY from NJ to have visitation with my son for the weekend, every Christmas for a week and a week in the summer. When he was of driving age and started working we still maintained a weekly visit either for lunch or my son coming to my home for the day. My son and I have a healthy relationship. He is turning 21 in 8 months and now my ex wants all arrears of back support for $200.00 a month dating from 2004 since I remarried instead of the agreement of $100.00. My question is "What are my rights in disputing the validity of the order and arrears?" |

The order still governs normally unless changed by the court but if you can show there was truly an agreement the court may adjust the arrears even now. Or you can pay but sue her as a civil law matter under the agreement that you two made outside of the family law court.
If need be email world law directly and the lawyers can probably help guide you. |
