My daughter is 19 and I have no documentation of her attending college. She has been out of high school for a year. A letter was sent to her mother requesting information of her transcript. Since there was no response,I had the child support order stopped. After three weeks, I received a letter stating that she is reinstating the child support order. What are my rights and how do I go about this matter? |

You received a letter from who? The mother, or the court?

I received a letter from the court to appear in court for re-instating the child support order.

If they can prove she's in college - which they should have to do - and your support order states you have to pay as long as she is in school (including secondary education), then you will likely have to pay again.
My Aunt's Ex husband immediately started sending his daughter the same amount of child support that he paid my Aunt when his daughter started attending college and child support to the mother stopped. It has been very helpful to my niece and was very well recieved by all. |

Ask for a copy of her transcripts and/or class registration and/or bursar's receipt for proof. But if she is returning to college and your child support order says you need to pay, then you will need to pay.
There may be an age limit that kicks in sometime as well, though. |

My child support order has been re-instated. It was closed because my child mother didn't produce documents stating that my daughter is register in college. The child support order was closed in Monmouth County and re-instated in Essex County. I went to court in October 2008. My daughter's mother showed the court officer a piece of paper stating she signed up for school,but no official document. I requested a copy of her transcript which was recorded in the court records and her mother was informed to send a copy of her transcript to Essex County court which the court has not received. HELP!!! Is this legal if she is not attending school and I'm still paying because her mother won't produce any official document stating that my daughter is in school?

Have you ASKED you daughter? Go to the child support agency in that county, explain your situation and request it be stopped.

The Child Support Agency is NOT going to stop support when there is an order for support. The CSEA is not a court of law. The best they could do would be to put the funds in escrow as they receive, but even that is not going to happen in this case.
If the mother was ordered to send a copy of the transcript and has not done so, then he needs to file contempt of court charges against her. |

what are "your rights?"
Your right is the ability to help you child with college. Should I say right? or gift? Maybe (just a suggestion) your priorities need to be re-considered. If she becomes the president of the united states will you bragged you helped her pay for college?.... Help her out... college costs a fortune. I've personally never knew anyone who was not studying psych 101 and not living off top ramen - and that's the truth. |

That's very judgmental. You have no idea whether this man can afford to pay for his daughter's college education, and it seems there is a good chance here that she is not actually attending college and that the mother is defrauding him.
