Goood morning,
My husband and i are just beginning proceedings with divorce(sep 1 year) keep in mind Ontario, Canada. I have been a stay at home mother for the 3.5 years of our marriage until he left , i then started to look for part time work while i enrolled my son in a day program partime while I worked. Durign these last 10 mos my son has been living with me on a fulltime basis with dad having access (no overnights) because their was no custody order. I am trying for sole custody of my son with dad hving specified access, because of his lack of communication with his son and visits and times that i have called he simply did not answer his cell, so co -parenting is in question, I have made the decisions for my son up until now and trying to comminicate with my ex is difficult. Also, he lives 45min away from his son and is a firefighter with lots of time off, however his son has school extra cirricular activities freinds birthday parties etc. My ex has aslo applied for sole custody and if not that 50/50 parellel parenting. I feel that for the stability of my son and consistancy that my home should be his primary residence and dad to have access. Two consecutive weekends per month (due to his work schedule) and one afternoon per week for an outing with son. I have heard that this is the norm. Will he have a chance of sole custody?? Even though his income is very high?? He is typically tryign to get out of paying child suport. Please help me with this , thanks very much . |

I think the nrom is every other weekend and one or 2 days during the week. This isnt for you its for your child. You said this is due to his lack of communication but then you say he is a firefighter with lots of time off so he should be taking his son, but then you say your son has school and after school activities and friends and parties??? what is it. dont use the child.

What the HELL makes you thing he has no right to overnights without a custody order? If you are still married, and there is no custody order, he has JUST AS MANY RIGHTS AS YOU, unless Canadian laws are FAR behind U.S. laws.
