I want full custody of my son!! Please give advice!!
I want to file for full custody of my son, but am nervous that I wont get it because I work a lot of hours (53+).
I left my son's father 6months ago and we chose not to go to court and had a mutual agreement notarized. We had plans of getting married and had purchased a house together, although the loan is in his name. I moved out since moved into a very nice 2 bedroom apartment, have gotten a new job where I now make more then my son's father, and I have been in school full-time for the past few years and recently switched my classes to all online so I could have more time with my son. Im just nervous because of my work schedule... I would be willing to change my job to one with mothers hours if I was receiving child support. Any type of advice or thoughts would be much appreciated. Thank you! |

He has a drinking problem for starters...
I was under the false impression that he would be spending time with his son when he had him and not passing him off to everyone under the sun. I would have just taken him with me when i left but i had to get myelf re-established and now I am. Any thoughts? |

Plenty of single mothers have drinking problems, yet still have custody of their children. Plus, I don't really see why this necessitates that you have full custody, unless you are also seeking to eliminate his visitation.

Well for starters I must say you made a notarized agreement that you won't enforce your right to take the matter to court - so this can be a problem. In addition I must say the allegations you have made about the father need to be proved.

Technically, if you live in the US - and were unmarried - you have full custody and cannot file for full custody. As that would be filing for something you already have.
Is the agreement not working anymore? |

The amount of hours you work are completely irrelevant to your case, go down get an attorney and file for full custody courts will not take a child away from their mother unless they are unsafe. The worst that could happen is you would get shared custody which is where you are already, if you get that, keep fighting until you get full custody. As long as you are in a stable home and your son is safe, work hours are completely irrelevant.

Really...my lawyer said an unmarried mother - who by default is granted full and sole custody unless the father files a motion cannot file for full custody. Maybe he's wrong...but I see his point and would be suprised if he was.
