I have a unstable mother in law who is constantly threatening me and abusing me and trying to unravel my family. Now she says she is going to sue me for either custody or visitation. I get nasty letters, phone calls and she is even trying to set up my husband and make him look like he is having an affair. I told her she needs to back off and allow some space and then see what happens but that isn't happening. I am scared she will take my son and run or what she did threaten in one of her letters is that she will get my son to hate me. Could you blame me for not wanting her around. What can I do can she really win? HELP

You have letters from her stating that she will try to turn your son against you?
If she brings a court case against you, all you have to do is show the letter to the judge. Reestablish control over the situation immediately. Inform the mother-in-law that she is no longer welcome in your house, and that she can have no contact with your son. Let her know that you will reevaluate the situation in two weeks, and if she promises to be respectful of you she may have visitation with your son, supervised by you, at some public location. If she threatens to file a court case against you, laugh at her and say go ahead. All this assumes, of course, that you have been good parents and she has nothing valid she can bring against you. |

hello thanks for the response, yes I have the letters and my husband and i did tell her that she needs to back off for a while and not see my son or come to the house and we said if she can stop the b/s for a while and show us that she can not be a threat we would resume visitation and thats what got me to the fact that she wants to sue. Would the legal system grant her visitation anyway. I am trying to be a good parent and protect my child from a obviously sick women. I will be devastated if I have to allow her to see him after all her threats.

All you have to do is show them the letters. They are not going to grant visitation to a grandparent against the wishes of both parents unless the grandparent can give a good reason for it.
