Confused child custody change

ok so this is kidna complicated so here i go.my ex and i split up nearly 6 years ago.our son came with me.i couldnt afford a lawyer and he wouldnt pay for one.well i got pregnant by my current husband and my ex finally filed for divorce.like i said i was young and working to support myself and my child and could not afford an attorney so i listened to what my ex was saying because i trusted he would to whats best for our child.well long story short he never told me the court date and didnt even tell me that we were divorced.we got joint legal custody and because i didnt know any better i thought we would each have 50%of the resposibility over our son.well i was wrong and when our son started school i went to seeing my child every other weekend and one day a week.well as hard as its been i asked my son if he wanted to live with me or his father and he said his dad because he never got to see him that much.so i left it alone until recently when my ex cotinually has violated our child custody agreement.he moved twice without even telling me,once he even had me watch our son and said he had some errands to run when he was really moving!then i went to pick up my son and he was limping,my ex said oh i think he might have broken his foot yesterday but i havent taken him to the doctor.so i took him and my childs foot was broken in 4 places.plus my ex will not get insurance on our son either even though it an order.now recently i asked if our son could stay with me this school year because it is what he wanted and my ex said yes.well he was suppose to go with me up to the school last week and i havent been able to get a hold of him for 6 days now.even my exs girlfriend thinks hes being a dick!do i have enough info to get custody of my son?theres even mpre than what ive wrote ive been keeping a log thanks for any help

ya he cant say anything about me.i have never used drugs never have abused alcohol and am a very good loving mother.he cant in anyway say that ive done anything to hurt our child

Then you have nothing to lose.
But I wouldn't dwell too much in court on how he treated you during the divorce. Your claims that he failed to notify you of the court date are not going to gain a lot of sympathy with the judge. It will only make you look irresponsible and foolish, regardless of what the actual circumstances were.
Instead, focus on what is going on now, and what you can do in the future.
