My X and I have a 8 mo old son. We just finished custody proceedings in June and I have 50/50 legal and she is the primary residency. I get EOW and 1 day during the week. We split a year ago and since our son was born she was wanting to move back in. She keeps saying this when we have a court date. (I had to file on her). About a month ago we got into a heated discussion and she got all irrational and dropped our son in the back seat instead of his car seat (during exchange of him) I then grabbed him and told her to calm down and then she could leave with him. She finally did and off they went. Well needless to say she filed a police report and tried to get an ex parte ppo on me. She didn't want to let me have my summer parenting time with him. I had to report to the police station and turn myself in. The circuit court judge denied the ex parte and wants to see us in court. I retained my lawyer as she was going pro se until she found out that I had retained my lawyer. She is not using the same lawyer that she had for custody. Now we have to meet to exchange our son at the police station. She has also brought things up that never happened while we were living together. (the judge asked us both if there was any DV and we both said NO) I had a pre trail on the DM and post poned it because the city courts want to wait to see what the circuit courts will do. She has also brought a ppo against my parents which has all lies and even provided evidence that has been altered. Then to top it off she then gave me our son for our 2 week summer parenting time.
I have been documenting everything. When she has denied me visitation (2 times), when she has said she wanted to move back, about her not wanting to start feeding our son, not wanting him to crawl "she doesn't want to have to work eight hours then come home and chase after a kid", now she is not even going to his 9 mo doctors check up. So any advice on the circuit court (same judge that was for the paternity/custody/cs case) and how to proceed would be greatly appreciated. |

Just keep documenting, keep following the established court orders, and keep your own nose clean.

I have been following courts orders and I have been keeping my nose clean. Its really frustrating to know that these mothers can just go to the courts and say things have happened when they haven't. Things seemed to be going fine until she doesn't want to do something. Then she gets very irrational. I just want to be there for my son. Is that too much to ask?

Courts like to keep their dockets clear. They get very annoyed very quickly with people who keep trying to re-litigate the same case over and over again.
