I have posted on another thread and recieved many negative comments. My "story" is true and what I post is ALL of it and nothing more. Please read and if you have any true advice, I will gratefully appreciate it.
My mother took custody of my daughter a little over a year ago. I signed a paper thinking it was for my mother to take my daughter to her doctors appointment. Yes, I know it was stupid to not read the paper from A to Z. Thought I had a mother I could trust. My husband and I are not unfit parents. When my daughter was living with us, my mother called DFCS on us for no reason. Of course, we passed the drug tests + home inspection. We are not at all unfit. No way, no how. DFCS closed the case once my mother had this paper I signed..and I have NO idea what I signed (I have no copy). I want my daughter back this has gone on too long. No, I am not waiting until a year later to start taking action- I've called numerous places to figure out what to do but just ended up with bullcrap, and DFCS will not do anything or offer any help. Advice is welcome. |

Your mother cannot take custody of your daughter just by you signing a paper. Custody can only be transferred by a decree of a court of law. If this paper was a legal document, then the clerk of courts will have a copy of it.
Go down to the clerk of courts. Ask them to see your case file. If there is no court order granting custody to your mother, then she does not have custody. |

I am going to go to the courthouse this morning. If there is nothing filed, then what do I do?

Then ask the police to help you take back custody.
If something is filed you can still disupute and argue you were misled, did not understand, were defrauded, whatever. The judge is not going to take a child away if you dont approve. |

***I went to the courthouse this morning. Went to the Superior Court Clerk-they searched my name and my mothers name. Nothing came up..Then she sent me down to the Juvenille (sp?) Court Clerk and they searched my daughters name/birthday. They found nothing. So apparently nothing has ever been filed..I'm happy about that. Now I just want to know what my next steps truly should be??

Your next step should be to call the Police to arrange to have them help you pick up your child.
Do not give them all the details of your story. Just tell them that your daughter is at your mother's house and she refuses to return her. |
