How should I proceed to get my daughter from her?
Hi
my wife has left home after a dispute with me from past 2 months. This is second time she left in our first dispute; elders united us by taking up a commitment from both of us. That time I had committed that I will not physically or mentally torture her and not trouble her at home. She had committed she will not take any drastic decision regarding her life like suicide Now she says she will not come back to live together. What should I do and I am worried about my 15 months daughter she is with her. She says she will not give divorce (or divorce) nor comes back. How should I proceed to get my daughter from her? If she is willing to reconcile I am ready. May I have to apply for RCR. But I fear if court dismisses my RCR because of the Some doctor diagnosis reports when she was ill(she was hyper tension )she had with her. I wanted to know can she claim maintenances from me when I will apply for RCR and she book a criminal case like 498A or DV-2006 after me filing for RCR. Can court dismiss my RCR based on cruelty physical or mentally to my wife. I have not done any cruelty on her till date. If she gives false impression to court can RCR be dismissed I am ready to leave with her if she comes back. Evidence with my wife- 1.Some mobile messages I had sent asking sorry and will not repeat and will take great care of you. 2. Some doctor diagnosis reports when she was ill. |

What is RCR?
To get your daughter back you will probably need to file for divorce. You will use the mother's refusal to let you see your daughter as evidence that you should be granted custody. |
