Wisconsin Custody & Naming
I've been reading recently and trying to figure out some of the things that go along with what happens and the lawyer i had seen for a consultation was an idiot in all regards.
So if I get something wrong please do speak up any assistance would be helped. I'm recently broken up with my girlfriend and she has been pregnant for a little while now (3 and 1/2 months). She has told other people i am the father and i know i am the father. She had previously been lesbian and i guess i was the rebound off girls guy lol. We where together for a little while and decided to start our family but she has recently changed in her views and feelings and the fighting started to happen blah blah end of story. I am not on really any speaking terms with her as she wont even talk to me to try and work out how we are going to work with the baby. I don't think she realizes i will be here for a long time and I am not going to give my baby up. As far as i know, so far i am filing the paper to say that she cant put the baby up for adoption and snub me out of the mix even if she says she doesn't know who the father would be. I also want to file for a genetic test, I have no clue whether or not she will sign me as the official biological father cause of the current speaking terms. I am honestly unsure if I can file for a test and still have the option of signing the paternity papers at birth. Any input on that would be much appreciated, I don't mind paying the money for the test but i don't want the option to sign to be gone. As far as my understanding goes, if I am there at the birth and she consents I am the father she can't name the child without my consent also so she cant name the child after herself without my consent because of equal guardian privileges right? If she lies and says she doesn't know who the father is and I am proven to be the father by a paternity test she can write whatever name she wants on the birth certificate....It is also known by many people that she knows who the father is and has admitted it so I have witnesses willing to testify her knowledge of me....That would be falsifying documentation if she chooses to not put me on the birth certificate or she puts someone else on right? I also can't be put on the birth certificate without my consent (or a courts order) and i would be willing to hold out till I have signed the paternity papers with her or it is proven by tests. In this regard i would still have had my equal rights as a father in naming the baby cause she is fully aware of who the father is. Therefore even if a month later I am proven to be the father she would be in violation of falsifying a document and having both parents consent to the babies name and could have the child's name re changed right? |

Realistically, I do not see any way you can influence the naming of the child against her wishes. Even if it were possible to take it to court because the two of you could not agree, I'd bet dollars against dohnut holes the court would side with her. AND they'd be pisses off that their docket was being loaded up with such petty disputes and probably hold a grudge against you because of it.
I was in a position very similar to yours 20 years ago. Save your time, energy, and funds for the big battles that matter. |

TY VM tbyte, a very good thought and if i am better able to have a relationship with my child they will know their history and lineage far better. Now off to read "parenting with dignity" lol
