I have a court order that I initiated from 2002.We were not married. In the parenting agreement, she insisted on sole physical custody of both children. Now 7 years old,and 16.She moved out of state a year and a half ago, with my permission. My son is acting up,like most 16 year olds.now my ex,(we were never married) wants to send him on a plane to live with me.I live in a studio apartment, and I am only allowed to live alone, and can't afford to move. What are my options?

Do you want him to come live with you?

If you do want him to live with you, file for a modification of the custody order. I'm assuming that you pay CS, if you do, you should file for a modification to lower the CS you pay ex and for an order for her to pay you CS. That should give you the money you need to move. |

its a matter of I can't have him live with me,or afford to rent a two bedroom here in California.I don't think she can just do this on a whim without approval.

This governs unless you or a court agrees otherwise! |

& there it is. you have to tell her if she just sends him to you w/o court & ur approval then she will be in contempt. BUT i don't understand-which obviously you didnt' want them anyways bc you LET her have full custody. that's sad. another example of bad fathering. 2nd if you care anything about your son & his life IF he's acting up in a way that a man needs to intervene (which he is right?) then you NEED to have him to save your son & his chance at college. he has 1-2 yrs left in h.s. you NEED to help him. He's your SON. THE END.
Another thing-do the child support. you can file for these petitions all on your own; you don't have to pay a lawyer. all you have to do is read (law forums, for example...or wiki, or scstatehouse.net (example) READ READ READ. File the petitions, go to court-get child support & get a 2nd job. That's how the rest of the world is surviving gas prices right now; you need to do the same. work. |

If my kids needed my help, I would do everything I could for them. But maybe that's just me.

Try to get another place and have the mother pay you child support. good luck. CAn anyone help me out? I am in a relationship with my boyfriend. We have a 1 year old child together. He had a child with his ex girlfriend when we met. Him and his ex also has another child who is almost a year in age. We plan to get married next february. He is current paying child support for both of the children he has with his ex. They agreed at a counseling session on the amount to paid, not before a judge. She threatens him every now and then to go for an increase in support payments. Neither of them has had a change in their financial or physical situation. I make more than he does financially. She is a spiteful
individual and I know she will want to get the child support modified once we are married. We live in phila, pa and she lives in delaware county. Will my income be considered when modifications are done after marriage? Meaning he will have more money to put out of his pockets and i be stuck with bills and our child or children to come? I am scared. Will my finances be jeopardized? I work full time, i'm in school, paying my bills, and taking care of my daughter. I am looking to purchase a home soon prior to marriage. Im confused on how all of this works. The ex girlfriend calls my boyfriend every now and then for extra assistance and complains about being broke because she has to pay her car note, car insurance, and other personal bills. She gets free health insurance for she n her kids, subsidy for the 5 year old. She claims she can't get subsidy for her infant because there are no funds. She claims the baby does not receive wic, which she was getting for her 1st child until the age of 5. How can I be exempt from filing joint taxes with him since he pays child support? My daughter is under my boyfriend's health insurance and I will be also after marriage. please help. |

A spouse's income is not normally considered when determining child support. If you have further questions, please start a new thread as this is not related to the original post.
