My son and wife are separated. They have 1 son whom they share custody. My son has child every Fri PM to Sun PM. My son has transported child back and forth from Mom's since separation. Mom has moved a couple of times, each further from where Dad lives. Mom is moving yet again, even further away.
My question is.....is it the father's responsibility to pickup and deliver this child every weekend? The distance and time it takes to travel to Moms' is getting crazy. It's taking away the time my son gets to spend with his child. Not only that, but with the price of gas, the expense to drive this distance is huge!!! |

No, not unless that is stipulated in the court's decision.
Otherwise, it should be the mother's responsibility to come and pick up the child from the father's house. Plus, if the mother is moving a significant distance away, you may be able to petition the court to require her to do all the transportation, though this would be difficult and I don't know that it would be worth the effort required. |

also if she is moving so much you should petition the court that if she wants to move she has to give a written statement so many months/days prior notice to the other parent & if she does this you have the right to bring this matter in front of a judge so maybe custody can be switched bc the father is NOT choosing to live so far from the child. if there is no order in place he can take the child and refuse to turn him/her over until the mom comes to get the child. of course this will cause hostility...but ya know. also if there is no order he needs to get one for her to reimburse him for expenses of time/travel. it was her choice to move she should pay. or at least do 1/2 the work.
