Lightbulb Non-Custodial Parent Help

I am the non-custodial parent of a 15 year old and a 12 year old. Both of my children have expressed intrest in wanting to split the time between me and their mother. I am wanting to know, if I have a chance at changing the visitation agreement? We have been divorced for 10 years. I live in Tennessee.

Mmmmmm......maybe....
If you really are a non-custodial parent, you would first need to get a shared parenting plan designating you a co-residential parent, and then you would need to argue that the children would be better off living with you than with their mother. Now, the testimony and preferences of the children may be considered by the court, but will not be the deciding factor.
The problem is, if the mother decides to fight you, you can expect several years of court hearings costing thousands of dollars, and by the time it is resolved your children may be nearly emancipated anyway.
So I would encourage you to work something out with the mother instead.

Thank you! All I am wanting is for both the kids and I to get more time together. Neither the kids nor I want them to be taken away from their mother. We just want our time! She is not the easiest person to deal with when it comes to getting more time with the kids. We do not have a good relationship, unfortunately. Thank you again!
