My ex and I have been divorced since 1999 in the State of Colorado. We went through a mediator and agreed upon everything mutually. I decided in 2000 to move to a further away destination. I did not legally know about filing for a motion to relocate the minor child. So, what happened was that he decided to draw up a new parenting plan and file it with the courts. I signed it, but he did not. A motion to modify the parental responsibilities was never done on his part. Some things happened in the past, where I received pro bono representation to solve them. When my pro bono attorney visited the courthouse in Jefferson County, he found the Parenting Plan filed in the case file. He had told me at that time, that this Parenting Plan was not approved by the courts, no fees were paid, etc. It just sits in the file.
Now, I have moved back to the same County as he lives in. I did not file for a motion to relocate, since it did not substantially change the geographical ties between us, it only made it better for him. Now he is trying to hold me to this Parenting Plan with agreements to make mutual decisions about her schooling, meeting half way for his visitations, etc. He originally was to pick up his daughter at my house for visitation and a variety of other issues. When we got a divorce, a Parenting Plan did not exist at that time. His wife mailed me a copy of this Plan and highlighted all over it to tell me that I am in contempt of the courts. It is still only signed by me, marked 03 JUN -4 AM 8:37, FILED COMBINED COURT, JEFFERSON COUNTY, CO and then stamped again with FILED IN THE DISTRICT COURT, JEFFERSON COUNTY, APR 19 2005 and then stamped on the bottom with DOCKETED 2X. My Attorney at one time told me that this parenting plan was not filed as a Motion, and is not valid. Could this still be true and I can tell him to refer to the original court ordered agreement. |

The last orders filed by or with the court normally still govern.
