waiver of child custody

Hi, I am hoping that you can answer a question. I am a married man with two boys ages 4 and 6. I recently found out that my wife has been speaking to an ex-boyfriend of hers for the past several years, several time per week. I am not comfortable with this situation, as this is not the first time that this has happened, and have asked her to stop. She has told me that she will, indeed, cease any contact with this individual. Since I have my doubts, I have asked her to sign an agreement stating that if she does in fact have any contact whatsoever with this guy in the future, she will agree to waive any child custody rights if we are to get divorced. Would a signed agreement stating that she will not seek child custody in the event of a divorce be legally binding? Thank you for your time.

No. Such an agreement would be practically worthless, except as evidence that he did not have high regards to her parental rights or responsibilities. The document, alone, will not get you custody.
