Confused What can my ex husband legally do?

i recently go a divorce and remarried someone else. i found out i was pregnant afterwards. i strongly doubt that the baby is my exs but me and my new husband agreed no matter whose it is we would put my new husband on the birth certif. now my ex husband is trying to get full custody of the unborn baby so his millitary pay won't change. he gets more money from the millitary for being married or having kids. he still hasn't told his chain of command that we're divorced. and its been almost four months. ive been cool so far. all i want is for my ex to leave me and my new life alone. he doesnt want to see the child he just wants the birth cerft. and i refuse to give him anything just for him to collect money. i dont even press the issue for the ex to pay child support if the baby is his. all i want is to just be done with him all together. but now hes threatening to serve me with a subpeona, and come to the hospital on my due date and take the birth cert.. i want to know what he can and can't do being that the child is not even born yet. and im remarried

hi there....
I think your husband has nothing to do with your life now because you already got divorce with him.It is your own choice if you want to put your husband's last name onto the birth certificate of your baby.
With regards to your husband's threat to you, i think,you should go to a lawyer who could give you an advice what to do.

He is the father. His name should be on the birth certificate.
You can fight it, but eventually you will lose.

First thing you need to do after the baby is born is to have the paternity test done. i dont know what state you live in but in colorado there is a presumed paternity. if you are married when the baby is born, the husband is the father. put your husbands name on the certificate, have the test done and if the test comes back that he isnt the father, you are going to have to change it. you also need to go immediately to the base and turn in copies of your divorce papers. like, yesterday.

Um.. If you read the initial post, you'd note that she stated only that it was possible, not that he was the father.

Also, it is possible to do a paternity test based on amniotic fluid, I suspect. So if you are having CVS or an amnio done while pregnant, a paternity test can be done before birth too. Google "in utero paternity" for more information.

The stress of uncertainty regarding paternity is not good for your pregnancy, so it would be worth the $ to do this. The peace of mind is worth it - if the ex isn't the father, then you can relax, and if he is the sperm donor, then you can start planning.
