Default custody in Canada

Hi. My question is , My son has court ordered 50/50 custody of his daughter. The mother has not been taking the child for her portion of the time for the last 7 months.

My son has recently lost his job and would like to move out of Province , does he need to go back to court first??

Yes, and his chances of modifying the custodial arrangement are very slim.
