I am divorced with one child from my marriage. When seperated my ex wife moved to PA. She filed for child support there and my order is set at $803 a month. We have no visitation order in effect, being that I lived in Ca and she moved to PA and I was in the military and only could see him when I flew there. Since then she has moved back to CA and wants me to have him for the whole summer. I am all for having him for the summer. She wants to get a job/home. The problem I have is she expects me to continue paying the full amount of child support. This doesn't seem fair to me, I have to pay her while I have him for three months? I have to pay for child care while I have him since I work full time. I want to see my child for the whole summer since I never have been given that oppurtunity before but I feel it is not right that I am still paying her for me having him. I feel like she is taking advantage of the situation and doesn't want to use the money she receives on child support on a summer program for him. If it costs her $800 a month to support him why shouldn't it cost me $800. I am not for her to pay me supprt but atleast let me use the support I would pay her for my child. What should/can I do?

No, it is not fair.
No, it is not right. Yes, it is legal and you need to continue paying support during the time the child is visiting you. Your best strategy here is to keep your mouth shut, take your child for the summer, and let your ex establish her residence in California. At the end of the summer, file for formal visitation orders, at which time you can argue that the child should have significant time with you, perhaps even 50/50 custody, based upon the extended care you provided over the summer. |
