My husband has a court ordered schedule a visitation in place which states that he is to be promptly notified of any illness of the children which require medical treatment. His ex-wife has not notified him at all of any visits to the doctor or emergency room that his 2 children have been. The way he found out was by the bill. He has to pay 100% of all their med. and dental expenses plus pay for their insurance. he makes only 12 dollars an hour 50% less than what he was making when they got divorced (plus we have 2 children together) and she is making about the same or a little more than him now. she does not have to pay anythingfor them. my question is: Is she in contempt of the order for not informing him of the doctor and hospital visits? If so would she be legally responsible to pay them?Any help would be greatly appreciated.

I would tell him to go back to court to get that modified. How in the world can he afford all that? She has a job. If he pays the medical she should pay all copays and anything extra. I would say if it written in a court order, she is in contempt.

Thank you for reply....He tried to get a modification but the judge turned it down....The judge did not take into account that he has 2 other children to support. we live in WV and the laws here are awful.....thanks again.....

That seems unusual to me. I think that standard is that the non-custodial parent is responsible for 50% of the medical expenses over $100.
Find out what the default orders are in your locality, and why his orders were different. Heck, read the orders again carefully to make sure you have interpreted them correctly. Under the orders you describe, the mother has carte-blanche ability to run up his medical bills as high as she wants with no cost or consequences for herself. I can't understand why a court would have allowed this. |
