How Do I Change My Son's Last Name To His Father's on His Birth Certificate
My son has always used his father's last name since birth. I never had the birth certificate changed when we lived in New York City after an order of filiation was granted by family court, right after his birth and after paternity was established.
I need to find out how to get the order of filiation to submit with an application to correct the birth certificate so I can add his father's name to the birth certificate and to change my son's last name from my last name, to his father's officially, even though he has never used my last name. Or would it be better to submit an Acknowledgement of Paternity (AOP) by his father who would not object at all to doing this. Which one would be quicker? But since I already was granted an order of filiation (but I do not have any copies or anything), I need to know how to send that over to Vital Records with an application for a Correction of a Birth Certificate so my son's last name can be permanently recorded as his father's, and he can get his drivers license, passport, etc. Son Born in New York City Current Residence, State of Maryland Thank you for your help, Beverly Last edited by chirosche : May 21st, 2008 at 06:40 PM. |

Local rules and procedures may vary. You should just call your clerk of courts to find out the requirements, or go down and visit in person.

But the birth records are in New York City and we live in the State of Maryland. The Order of Filiation was granted in New York. How do i get that?

Contact the clerk of courts at the court were the order was made. They should be able to mail you a copy, though they will probably charge a small fee.
From now, keep a copy of ALL your legal documents in a safe place. |

You may want to firstly call your local county clerk and they will often direct you and even have forms.

The clerk will often have legal forms for name changes.
