i want to go to family court and file an order to show cause and get custody of my kids. my husband left the home and took the kids with him and is using the situation to get out of paying support and also to get the house away from me. what am i in for when i petition for custody in family court? will a decision be made on the spot that day or will there be nothing but red tape ?

Not necessarily. If both sides want to fight it out and gather evidence etc., it can take time.


But the court will make a temporary order normally and that order usually tries to have both parents remain involved-- and with visitation.

if i filed for custody would the order give me the kids and him visitation? im confused. he took them from me last week and now the kids are being distant to me and dont wanna talk to me. would that work in his favor?

It depends on where the kids lived the longest most times. Also how old are the kids? The court could possibly allow the kids to offer their wishes and consider them.

they are 16 and 10. they lived in this house all their lives until my husband had a plan to remove them and go live with his mother. he is using them to try to get the house away from me and get out of paying child support. of course they will want to stay with him since hes letting them do anything they want and letting them run the show over there
