bank acount frozen / florida

i have gotten alittle behind with my child support ($836) . my son is 4 years old . i have not been getting the visitation i should because whatever reason my ex makes up every week . so i have been unhappy with the situation and stoped paying .

they send me a letter about suspending my drivers liecense . so i go down a work out a contract where i am going to pay $350 now 4-11-08 and pay my $280 by the 5-1-08 . i pay the fees just as asked to aviod loosing my liecense . then on 5-4-08 i try to use my debit cards and they don't work ? i call the bank and it seems child support froze my accounts ?

i go down to there office and say say that the contract is still fine and they have no idea why this happened . i was given a number to call , but no one answers and no one returns my calls .

now my bank says they took $1283 and froze my account for 60 days ? i have checks i have writen out for rent and other bills . i can't put more money into my account because it's froze . they even froze my buisness account also because they were linked together . the rest of my money is locked into my bank account i can't take any money from my account .

i can't beleave this , what do they expect me to do now ? they have about $2000 of my money from one month . i can't use any of my other money because my acounts are froze .

some lady answered the phone yesturday at about 10 mins till 5 oclock . she said she would figure out the problem tomorrow because the computers are going down at 5 oclock . i call all morning long and no one answers ?


now i have no visitation and no money . if i have the contract and receipts of what i have payed , is there anything i can do ???

They normally cannot do that for a month delay in payment.

Call the bank persistently and ask for a description in writing.

You may sue for costs etc. in small claims if this was done wrongfully.

You cannot withhold child support because the other parent is withholding visitation. Neither can she withhold visitation because you have not payed child support.
Child support and visitation are two separate issues.
If she is withholding visitation, then you need to document it and file a motion for contempt of court against her. However the fact that you stopped paying child support is NOT going to get the court's sympathy.

it seems that my contract says payment do on 4-30-08 but thye reveiwed my case on 4-29-08 and it was not payed so they froze my account . i did make my payment on 4-30-08 so i am not at fault .

they want me to file a emergency motion to ask the judge to release my account . they said with my contract the judge should rule in my favor . if i want to let my rent check bonce then she can file a hardship for my rent payment . i never bonced a check before and they want me to let it ?

this has been the nothing but problems .

how would i go about fileing for small claims case ? what about court fees?

Sounds like bull to me. They did not need a court order to freeze the account, so they should not need a court order to release the account. They should only need to fax a letter to the bank.

Do not stop payment regardless....because your x depriving you from your child...she did same thing to me, i had arrearage of 9,000 when she was 6 years old...IRS recapturing tax returns of mine, which is fine...by age 11.she turned 18 on 2005 and i had arrearage of 2,000 dollars left...i payed them 500 dollars lesser from c.s. agency espectancy, I paid it off in four months..just to get it off my back! she just grad from college 08 this year of May, thankfully she had scholarship and I went w/o missing it in the world as I missed her high school one bcause her mom says' am not invited as this one, well, she's an adult and i'm went!. Keep paying regardless, because it's going to reflect/affect on you!

If you havent realized it by now ...we are screwed ..family court can care less about your child seeing a parent ...its all about the money and will never end ...we are in family HELL...it is how we get stuck to for sticking it to a woman...face it they make our lives a living hell...and they dont care...


they froze my accaount for arrears...and now the bank is charging me a fee
for the account..that i cannot use ...so lets see ...she wins ...the bank wins
and family court devours another family ...and we are screwed....not to mention the poor child ....this is a truly satanic system...welcome to HELL!!!


my son makes twice what I make and she works for the court...snd she owns 3 houses...I make 8 dollars an hour ...they can care less

Do. Not. EVER. Do this.
Child support and visitation are two separate and distinct matters. If you stop paying support, you have seen what happens. If the mother is interfering with your court-ordered visitation then file a motion requesting that she be charged with contempt of court.
Now, you are just going to need to be patient with the child support agency. Know the name of your case worker and treat them with courtesy. Keep after them until they get this resolved.
