my husbands ex girlfriend is on welfare in new york, she has his two kids which we pay support to her on. now the government is trying to collect more support because she is on welfare.
if i can prove that she is lying on her section 8 welfare, 1. because she owns a home that she is renting in another part of the state. 2. because she models for companies charging 300 per hour. will the state take this information and possibly not make him pay another 25%. thank you i have contacted a attorney, but i like more than one response. tbyte if you read this, what do you think. your advice is the best on here. |

If she is making an income and not reporting it to welfare she is committing a crime and can be charged. Also, if she is making more money than she was when the support order was made I believe the father can go back to court to get a modification done to the support.

if i find the information on the internet that she generates income, i mean she does own a home and she is advertising it online for a rent to own and she advertises what she charges for her nude modeling and etc. is that liable in court.
what other ways can you prove income, also on the document that was sent to us, she used a false last name and she used her social security number for one of the children , is that legal. thank you so much for you help papa john |

A lawyer would be able to obtain the information needed to gauge her income and whether it's been reported or not. And yes, anything you can find, as long as you can prove it is legit and it's her, can be used. Regarding the advertising of how much she charges for nude photos, you would need to prove she has actually made money from this.
Also, unless she has legally changed her last name then yes she did commit a criminal act. And as you stated that she did this in a document she sent, if it was sent via the postal service I believe that could be classed as a federal offense under postal laws. And definitely using a child's SS number is illegal if she used it as her own. Was this document a court document? If so she sounds like an incredibly stupid person for doing what she did. It was a legal document sent to us by the state of new york, child support . the government is trying to collect money from us to pay for her welfare that she claims to be so poor to collect.
on the legal document that was notorized and sent to us by the government, it uses a last name that is not hers, she is using my husbands last name for her name and they were never married. her legal documentation including her social security card are under her born name. she also used her social security number with one of the childrens name, instead of listing the child's actual social security number. she doesnt know the numbers because we have the social security cards and not her. So is the document even admissable in court due to the fact that half of the information is incorrect. i bet you the reason she did it that way is because she herself owes child support on another child that she abandoned in puerto rico and has never went to court. what all should i tell my attorney?? Umm heheh "blush" just trying to help.
That woman is guilty of a criminal offense, possibly more than one. If the laws are the same in the states as they are in Canada then just the fact that it is a legal court/government document makes it a federal offense and it is also considered fraud (the fact that it was mailed makes it mail fraud as well). Make sure your lawyer knows about it and also make sure you report it to the court. |

thank you so much, i did send all the documentation to my lawyer today and copies of how it was fraud, i will keep you updated on the situation. i will go by the name lioness. so you know its me

papa john,
okay, so the attorney is secure now, but a few things i found out. i found out that she owes child support on a child that she abandoned in puerto rico, is there anyway to bring that up in court. i have the docket number for the case. can you file child support on someone else if you owe it too?? just wanted to talk some more lioness |
