judgement for child support enforcement in Alabama
My ex-husband and I divorced in 1988. I could not find him. My husband adopted my children in 2002. He returned to the state in 2005 after changing his name and my children being over the age of 18. I have gotten a judgement for all the arrears. What can I do to get this enforced? He doesn't file taxes. He works "under the table". Can I place a lein on his property or seize it and sale it to settle this matter?
Does anyone else have these same kind of problems? |

Was your most recent judgment in civil court or in family court?

It was in family court.

If it was in family court, I'm not sure you can do anything to expedite the collection, which is the responsibility of your Child Support Enforcement Agency.

I was told that in the state of Alabama the sheriffs do not answer to anyone other than the constitution because they are elected officials.
It is an election year. One of my friends told me to go to the media and show what is going on because with child support there are a lot of people that could relate to the frustration. This might force someone to do something because it would make this towm look like they are not concerned with dead beat parents. |

There's not much of a story for the media until you have allowed the CSEA every opportunity to collect the money.

I have recently been in contact with several government officials in Montgomery regarding this issue. I even received a phone call from the AG and met with him in Montgomery. I am convinced he is truly concerned.
The legal system falls short in supporting single parents and enforcing the laws that have been established. I urge you to write to your Representatives, Senators, Governor, and the Commissioner of the Alabama Department of Human Resources. Their offices need to be overwhelmed with letters regarding this problem I have been fortunate enough to find a Representative to help me in my efforts to find a solution and implement a change to the current laws regarding child support collection, enforcement, punishment as well as the criteria that must be met in order to obtain temporary assistance from DHR. My desire is to addresss these issues before the state legislature at some point in the future. I would be more than happy to hear your story and possibly share it with other government officials at my next meeting. |

"Unregistered", I've seen a lot of concerns about Alabama's family courts on this forum, and you seem to have had some success on starting to address the issues. Perhaps it is time for you to become "Registered"?

what does people being in debt have anything to do with people not paying their support??? Fathers and or Mothers have a financial obligation to their children and if you are divorced and need to pay support any way you can 1 job or 3 jobs although I have to say that if you are diligent in paying what you owe you should be able to see your kids on a regular basis
