My son lives with his mother in germany where men have virtually no rights (concerning "their" child(ren)), especially if never married to mom. The nazi legal system won't help but I believe the following would be illegal in CA where I live.
After 4 years since his last visit, he is finally getting to return to the states for a visit with just one catch, I have to pay his mom double dadtax (aka "child" support). Yes, as part of her agreeing to let him come to the states, I am suppose to voluntarily pay her double the current dadtax and send it to her sisters bank account so the welfare agency in germany doesn't find out about it. I know as a man whose son lives in germany where they have jurisdiction, there is nothing I can do in their legal system (if I try to report it, she'll just retaliate by not letting him come visit me in the future). Anyone know about similar laws in CA covering such matters? Any ideas, suggestions, etc? |

Is there a court order in place for custody, either in germany or the states? If no, then play her little game. Pay the money, get your son to visit you then refuse to return him and file for custody yourself. I know it sounds devious but if you are a good father and the mother is playing these kind of games then you too have to play games. Also, have you thought of reporting her to the German authorities over her trying to circumvent their laws regarding your payments? If not you might want to do that. Try to get a tape recording of her discussing what she wanted to do and why and use that. Again, I know it sounds devious but now a days.... fathers have to do whatever they can to stay in their children's lives.

No court order, when the two parents aren't married in naziland, mom automatically without any court proceedings receives full custody BGB1626. Fathers there have taken cases to supreme court of naziland/EU, losing in naziland but winning (only $$$) in the EU court of human rights (after not seeing their kids for years). The Hague conventions clearly state that the place where a child resides 6 months continually is their place of residence and they have jurisdiction, thus no help there, the US courts would send the case back to naziland. Reporting it? "if I try to report it, she'll just retaliate by not letting him come visit me in the future" Plus the welfare/child services office are "manned" by man-hating women who ..... well they ain't going to help and reporting her would piss her off resulting in me probably not seeing/talking to my son. Thus, your ... "fathers have to do whatever they can to stay in their children's lives." Looks like there is not much to do in this case other than let myself be extorted. However, I am very interested in knowing if CA has laws against this, haven't found much on internet, anyone know? |

That is dangerous advice, papajohn. Germany has jurisdiction, and the children would eventually end up back there, and the father would likely be stripped of all visitation rights.
