Default Lien for Non_Child Support

State - FLA

My ex-husband is in arrears for CS. I have seeked modification in 2007, as of today, my attorney has served him and we've been to court three times. The two times he had various excuses for the reason he hasn't provided financial records. He's a gov't worker and wages are garnished based on original divorce decreed; however, its hit or miss one minute support is garnished for a few months than it stops, etc....

Anyhow, is there a way to file a lien against him in the event he trys to buy or sale real property? Plus, is there a way to notify IRS when he does his taxes that he's in arrear?

If yes, where do I go? What are the forms? Yes, I have an attorney but the majority of my retainer has all gone toward everything else but the modification. There have been 4-attempts for discovery and the judge just granted me that my ex will pay my atty fees and now they want his work supeona.

Frankly, I'm not getting anywhere after two years of a modification of CS.

Is he paying child support directly to you, or through a child support collection agency?

He's wages are garnish (court order) and the money is to the Fla. child support depository which is distributed to me by them. The issue is, he has an arrears and child support deduction from his pay check has stopped.

If he is employeed, then the CSEA should be responsible for contacting his employer to garnish his wages.
Also, the CSEA should be responsible for notifying the IRS of his arrears and intercepting his tax return.
Either way, you need to follow this issue up with the CSEA.
