custody question

I hope you get this sorted out! I understand everyone's view here but it all boils down to the fact that everyone is human and everyone ahs family that they love. And there are times that everyone, doesn't amtter how high they are in the degrees of law, have issues arise where they may want to be closer to family. If you move closer to be with your family who are in need, maybe a different kind of schedule can be worked out with exchanges. It sounded like you exchanged them on a daily basis on his week because you pick them up from school. But if you came to an actual "week on week off" schedule, you and your ex would only have one exchange per week. And there would not be a ton of driving for each of you.

I am wondering if anyone knows how the law works with a parent who does not see his child or pay for her either. I heard that if he a goes a certain amount of time he gives up all rights to her with out signing anything I just go to the court to get full custody. It is like abandonment.

well that wouldnt exactly work out. right now we do have then on a week on and a week off. on his week, i pick them up from school, help them with their homework and then he picks them up after he gets off of work. If i were to move closer to my family, it is 3 hours away. there couldnt be the same situation without some serious changes. the kids would either have to go to one school and he wouldnt see them everynight of everyother week or the kids would have to go to 2 different schools, one week here and one week there. there would be alot more driving.

No, it is not that simple, if only because nothing involving our family courts is simple.

The courts will not cut a parent out even when the parent has been a lousy parent.

It is always preferable-- if at all possible-- to let the parents be involved and that is the rule that governs most courts.
