I HAVE CUSTODY OF BOTH MY CHILDREN. FATHER WAS GRANTED EVERY OTHER WEEKEND VISITAION. HE NOW HAS A BENCH WARRANT OUT FOR HIS ARREST. CAN HE STIL L EXERCISE HIS RIGHTS FOR VISITATION?

Probably. I doubt there is anything in your court orders stipulating that his visitation would be suspended if there is a warrant out for his arrest.
Plus, a warrant does not imply guilt, so I doubt that it would curtail his other rights. If he was involved in a violent crime and he or his situation represented a danger to the child, you could petition to have his visitation either suspended or supervised...though he most likely would not show up for it! |
