Erratic child support payments.

The Father pays support which is owed weekly.

The payments are purposely erratic. Often late over three or more weeks. Sometimes delivered by hand, sometimes by mail, sometimes by certified mail. Occasionally, a week is skipped due to the erratic payments. Keeping track of it is very difficult. Furthermore, when confronted about patments, the Father becomes argumentative and verbally abusive.

However... when checks arrive, they are dated as if they were written on time. One check for each recent week, skipping certain weeks, and then mailing them later... MAYBE.

The Mother recently filed for the payments to go through the state. At the time of filing, the Father was 4 - 6 weeks behind/missing. Also, the Divorce Agreement states that he shall NOT pay through the state UNLESS he is in default. The very next day after the mother filed, checks showed up at the house.

He will obviously pay his arrears by the court date. If judgement favors him, and he is NOT forced to pay through the state, he will revert right back to his erratic payments. Also, the Mother will be denied the cost of living adjustments.

What can she do about this?

That sounds completely bogus. What State are you in?

New York doesn't automatically funnel payments through a Child Support Agency?
Check into that.
Meanwhile, go ahead and make your request, state your facts in an affidavit. If he contradicts you and gets into a he-said she-said argument, suggest to the court that the payments be sent via certified mail.
I can tell you, courts do NOT like their time wasted with this stuff, and would likely see either certified mail or the Child Support Enforcement Agency as a quick and easy way to get it off their docket.

We will suggest that the Father be subjected to pay Child Support weekly via Certified Mail, but only as an alternative option. However, we will be unable to receive said mail until Saturdays, as we both work and will miss the mailman during the week.

We would prefer he pay through the state, though, as this will guarantee the Cost Of Living Adjustment she is entitled to.

At least it's getting paid...some people to see any money at all.

i get mine thru nys child support and its great when hes paying--he is self employed so when he stops its a problem but this happens to be one system that works well--they mail a money order and it goes directly into your account almost over night
