I have had custody of my children since October following my ex\'s arrest
and subsequent no contest decision to a child neglect charge. A magistrate has signed a \"Recommended Order\" allowing my ex 1 night overnight visitation with the children and to pay me child support. When I called the court to inquire about Support payment they said the Recommended Order,although signed by a Magistrate, is just a recommendation and does not have any effect until signed by a Judge. Is this correct? I do not want to give the children to her if I am not required to but I do not want to disobey the Court if I am supposed to???? |

Yes. The court orders are not valid until approved by a judge. Consult your attorney on the specifics.
