I live in North Carolina, my 2 middle school age children are living with their Grandmother in Ohio, while there Father works out of town. I initially did not want to uproot them from their school and home. My divorce was final, however the initial parenting agreement was never filed, and there was never a court order by a judge. I recently found out, my children are being neglected, and want them to live with me. Both children have voiced they want to live with me, as I talk to them daily. Can I go to Ohio and bring them back to NC? If so, would I need to file for custody in NC or Ohio, as they have only lived there for 4 months, however they have been residing with thier Father for 2 years?

The divorce was finalized, but there was never any parenting agreement finalized?
This is an absolute mess. You have to get an attorney to advise you on this, no doubt. Someone will have to take a VERY close look at the details. Until then, do nothing to disturb the current housing arrangements of the children. |
