Question can my ex stop me from going out of state?

I have a almost 4 year old, and I am moving out of state. I just broke the news to him, he wasn't happy, said he was going to take me to court. We was never married the child was born out of wed lock, so he has never ligitamized the baby, can he now take me to court and stop me from leaving the state?
