Question Parent Abandonment

My fiance and i have been together for 7 years. He has full custody of his 8 year-old son. The bio. mother has not attempted to make contact since he was 3 yrs. old. She has been in/out of jail, drug treatment, etc. Never has even sent a b-day card. He gets no child support and never has. I have raised, nutured, and supported him as my own and love him very much.

Me and his father are getting married in June and i would like to celebrate a legal adoption of him by me on that day as well. Is this possible. What does my fiance need to do to make sure i can legally adopt him????
Does he need to file w/ the courts?? Parent Abandonment after 5 years of no contact??

She will normally have to agree or you will have to go to court and prevail over her if she does not agree. It is hard to win if she objects.

you need to be married at least a year before you can adopt this child. you cannot adopt him on your wedding day, no judge will allow it when you just got married.
