I have a 1 and a half year old daughter. Her Dad hasn't lived with us in a year and hasn't seen her in 6 months. We were never married but he is on the birth certificate! I don't want her to see him so I have kept him away. He hasn't filed for visitation and is now talking about doing so. What are his rights? Can he take her for a visit even though I don't want him too? I can't find any links on the internet that state what rights either of us have legally!

Yes, he can sue for visitation. And I wish him the best of luck.

eh9ncnUnless there is a good reason he shouldn't be allowed to be around the child, he is the father & has a right to be with his child. He would have to present a danger to the child before the courts would deny him his rights.

That is soooo selfish! my daughter was born out of the wedlock also, I was 19 and my xgf was 17 and at 18 we had the baby (born 87), both grad from high school as I went to college at age 20 and work at same time as I was still with the mother of our child, things weren't working out so we started to go on our own ways as I was 23 when we broke up...I end up paying child support from the day she was born and did so! My daughter continued seeing my mom and her uncle (my older brother - be fathered my daughter along with his fiancee) and I from time to time, during my daughters growing years...from time to time my daughter would go over my moms house with raggedy clothe's for the weekend's as my mom takes her to Dayton's now Macy's nice/xpensive clothes, my Mom started to get arritated when she sends her home has nice clothing and when she comes over it's all second hand clothing. then again my mom started to keep some of the clothing they buy so when they go out for a stroll that she has nice clothes, when my daughter mom finds out how come she can't bring the some clothes that my mom bought her?..... why? (your opinion) it's been going on for years until age of 11 years old...(kids at that age, don't really wanna hangout with grandma or gramps..on their own with their little friends) any behalf on my years of paying child support and paying my loan, as I tried to see her as much as I can over my mom...her mom would have a fit of me seeing her that my mom was supposed to report to her when I come over (i'm not a threat nor a dangerous person to my daughter) my daughters mom thinks when I would come over to my mom's house that I have a girlfriend that would be mothering my daughter and would be a bad influence that of my daughter seeing me with different women. Well, I was to busy going to school and working so I could keep up with all the bills and for myself to survive from time to time had two jobs to survive, I've dated, but not in the picture with this situation i was going through behalf with my daughters visitation. My mom, told her one day that "this is my house, he's my son and he's daughter" (my x is a demeaning, manipulative, disrespecting controlling "B") and she has the nerve to accuse and assume what she was saying about me....and here she is doing what she's accusing me of... her best friend which is one of the godmother to my daughter is telling me that she has been borrowing money and not paying back....not just to my mom, but other people. I ask my mom if she has, my mom say's she has so my daughter would have food and such at their house...Well, I found out that her other boyfriend and friends, from time to time would party untill 3 am with my daughter around feeding them as well! she has two other child from different father? me a bad influence? I should of had a clue(then again, I was young, dum, full of rum) during her years, she (my daughters mom's mom) had same situation of her mom and dad (divorce) with her mom having a boyfriend, depriving her seeing her dad when she was living with her mom. Seems like it was past on from one generation to the other!
All these years my daughter had been brainwashed, bashing on me and side of my family for no apparent reasons, my mom's last wishes that she did'nt want the mother to be there at her funeral when she passes away (last year of Aug) and wanted my daughter to be there and just her, we did'nt tell her (daughters mom) because she would use my daughter as weapon for her not to come to my mom's funeral service! she was just a disgrace to my family and mom's friends...now she's graduating and tells me my daughter does'nt want me there? I've read some of the comments that on my daughters myspace website coming from her mom saying "some people just can't take a hint"? she sent a message on myspace mail that my daugter does'nt want me there!? but glad she is graduating college this year, this weekend! she is now 21 an adult and her mom still controlling her! I'll be there anyways w/o an invitation! |

I have a more severe issue but what has he done wrong? It sounds as if you are not allowing him at all... my son is 7 and his real father chose not to se him or pay support for the past 2 years so in this case i believe he has no rights My son has gone throgh hell and is now doing great! But in your case if he has done nothin and has tried seeing the child then why cant he?
