Default total loss

I was driving my moms jeep that only has liability. Some guy who was on a controlled substance hit me from behind sending my jeep upside down. (rollover) He was driving his parents car that has insurance but on the policy it says he is an excluded driver. So now the insurance is saying that they are going to deny the claim. So its as if the guy is not insured. So ppl are saying to take him to small claims court but all I could get is 5,000 which is not enough for my medical bills nor the cost of what the jeep was worth which was 7,000. So thats it, someone hit me from behind didnt have insurance and my car is totaled and I'm the one that suffers. Why does this not sound right to me?

You could seek insurance counsel to file against him and his parents; or settle for a lesser amount and handle it in small claims.
