There is an accident occured not a while ago. One of the results damage of this accident is the defendant loss his memory and no recollection of whatsoever happened in the accident. In this case, can the plaintiff still sue the defendant under the tort law? and can the defendant be exempted because of his condition? can anyone please answer it using UK's statutory laws? thank you

he can still be sued on other evidence...not D's testimony

But, he loss his memory and he cannot consent of what he did because he doesn't remember at all..still can be sued? what if he is an employee of a company? can the company be held vicariously held to be liable? thank u
