Default A car is crashed after it is sold

Tom had a car. He sold it to another person Mary, but they didn't sign any contract. Before Tom gave Mary the car, he had already received the money from Mary. However, before Tom gave Mary the car, Tom's friend John drived the car and crashed it. The point is, John doesn't have driver license and Tom knows this, but Tom still let John drive. Actually Tom sat next to John when the accident happened. By the way, the car's title was not with Tom's name but another guy's name (but I don't think it matters). So, who is responsible for giving back the money to Mary? Tom or John? or no one?
