in the parking lot of my workplace, a delivery truck driver knocked over two cement pillars that are approx. 10 inches high (after they fell) the employer knew of this and made no attempt to either move these, put them back up (they are 5 feet high when standing) or place any caution tape or other warning signs around them. they have been there for weeks now. the other night i was leaving work and it was dark and i backed over one (they are not visible b/c they arent very high and there is no reflective tape on them) well it ended up under the engine section of the car and my car was actually resting on it. it had to be physically picked up and moved off the pillar with the help of coworkers. well my radiator drained instantly, and i am sure there is other damage....my employer says they are not responsible what so ever!! is this right?

They are responsible if it was a danger that they failed to warn of and you really could not see it.
If you go to small claims a judge would decide how reasonably you were driving etc., and how much risk that damaged pillar created. |
