Question Freak Accident

My fiance was involved in an accident at my family's supermarket business, outside our receiving door on the adjacent paving. This happened
in May 2007. Whilst he was on foot directing the truck to reverse park in
the receiving bay, his leg was crushed between the delivery truck from our
headoffice warehouse and another vehicle. He has so far undergone 3
operations and is still using crutches and a special brace to move around
slowly. With the assistance of a lawyer [who only deals with "Road Accident
Fund" issues], we are in the process of claiming from the road accident
fund which will take between 2-3 years for any form of payout. His fulltime
job is a dance instructor and works with me at the "SPAR" supermarket in his free time.
As a result of this accident he has been unable to work at all and has a
result lost all his dancing students. Although my family is helping him
financially as best they can, he has lost his income from his dance teaching
and if and when he should recover he will have to find new students from
scratch which is going to be difficult and time consuming. "SPAR"
headoffice stated to us on the phone that it is not their responsibility to
pay him out anything, as the accident happened on the paving outside of the
store and that the "Road Accident Fund" is the liable party. It just
doesn't make sense to us that we can't sue the company that the truck
belonged to. My partner has been through a lot of trauma as well as
financial loss as a result of negligent driving on the part of one of their
employees.
I would like to find out if we can sue "Spar" headoffice directly and if
so, how we can go about it and what type of lawyer would we need to
represent us.
Please advise as we are quite desperate for some assistance.

t is certainly possible you have a case based on what you say here; you should take a brief description of these events as well as your medical records to an injury attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis--no fee/ no win-- if they think you can win; you would pay only if they collect for you...
