hi,
over 2 years ago i had an accident on the dual carriageway where my bonnet raised, so using full hazards and warning i calmly manouvered into the hard shoulder and had virtually stopped when a rigid lorry clipped my offside rear quarter. the distance of the lorry behind me was witnessed by two people to be about 60metres away when i started manouvering, which in there opinion was plenty enough time for the driver to react.(acceptiblre stopping distance is about 50m). even though i was in the hard shoulder so shouldnt matter. the lorry driver is even noted to have said (by witness) he wasn't looking at the road. the problem is that jmw solicitors are representing my case (liability has not been established) but they were instructed by norwich union (my insurer), but the insurer of the lorry driver was also norwich union. surely jmw carn't be representing us both??? it has taken considerable time and pressure by me to get any progress from them over the 2 years. each time i do i end with them saying there have been problems recieving statements, phyisical examination reports not arriving and they also seem to wish me to take the blame (not outright saying it). i do not think this is quite right and not fighting for my best interests. your opinions on what to do next would be helpfull? many thanks lee uk |

Have you complained or objected to your agent at the company or his/her supervisors? The appointed solicitors do have a duty to diligently defend you.
